No professional advice
The Kinto Global platform is a diagnostic and advisory tool. It does not constitute professional financial, legal, tax, investment, or regulatory advice.
All outputs generated by the platform - including scores, findings, action plan recommendations, and reports - are indicative. They are designed to support your decision-making process, not replace it.
Business decisions, implementation choices, and strategic judgements made on the basis of platform outputs remain the sole responsibility of the user, their organisation, and any qualified advisors they engage.
Acceptable use
You may use Kinto Global only for lawful business purposes consistent with the platform's intended functionality.
You agree not to: (a) reverse engineer, decompile, or attempt to extract the source code of the platform; (b) abuse or circumvent API rate limits or access controls; (c) upload or input third-party confidential data without the appropriate authorisation to do so; (d) use the platform to store, process, or transmit data in violation of applicable law; or (e) attempt to access accounts, data, or systems belonging to other users.
You are responsible for ensuring that all users within your organisation who access the platform do so in compliance with these Terms.
Intellectual property
Kinto Global and its licensors retain all intellectual property rights in the platform, including the software, algorithms, templates, checkup frameworks, design system, and branding.
You retain all ownership rights in the data you input into the platform ("Your Data") and in the reports and outputs generated from Your Data.
By using the platform, you grant Kinto Global a limited, non-exclusive licence to process Your Data solely to the extent necessary to provide the service to you.
Payments and billing
Subscriptions are billed through Paddle.com Market Limited, our authorised reseller and merchant of record. Payment terms, plan features, and pricing are as described on the pricing page at the time of purchase.
Credits consumed during an active billing period are non-refundable. Unused credits do not roll over to a new billing period unless otherwise stated in your plan.
You may upgrade, downgrade, or cancel your subscription at any time. Changes take effect at the start of the next billing period.
Termination and data
You may cancel your account at any time via the platform settings or by contacting hello@kintoglobal.co.za.
Upon cancellation, your data remains accessible for 30 days to allow for export. After the 30-day retention window, all workspace data is permanently deleted from our systems.
Kinto Global reserves the right to suspend or terminate accounts that materially breach these Terms, after reasonable notice where practicable.
Limitation of liability
To the maximum extent permitted by applicable law, Kinto Global's total liability to you for any claim arising from or related to the platform shall not exceed the fees paid by you to Kinto Global in the 12 months preceding the event giving rise to the claim.
Kinto Global shall not be liable for indirect, incidental, consequential, or special damages, including lost profits, loss of data, or loss of business opportunity, even if advised of the possibility of such damages.
Nothing in these Terms excludes or limits liability that cannot be excluded by law.
Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa.
Any dispute arising from these Terms or your use of the platform shall first be referred to good-faith negotiation between the parties. If unresolved within 30 days, the dispute shall be referred to binding arbitration in Cape Town, South Africa, under the rules of the Arbitration Foundation of Southern Africa (AFSA).
